Automobile Accidents
In Ontario a “No Fault Benefit” system was imposed in the early 90’s. However, this system has been through numerous significant changes.
It is important to obtain proper legal advice with respect to your particular rights. Do not assume that because someone you know had or did not have a claim that the same applies to you.
The No Fault system divides your potential rights into two sections.
No Fault Benefits (Accident Benefits)
Regardless of fault you have the right to collect the following benefits from your OWN insurance company, if you are injured in an accident:
- Income Replacement Benefits
- Or non-earners benefits
- Medical Expenses
- Rehabilitation Expenses
- Attendant Care
- Housekeeping Expenses
- And certain other benefits depending on your particular situation
These benefits are subject to certain limits. However, if your injuries meet the legal/medical definition of “Catastrophic”, these limits can be increased significantly.
